The AAUP joined an amicus brief submitted in June by the American Council on Education and other higher education organizations in support of a preliminary injunction seeking to delay the August 14, 2020, deadline for the implementation of Title IX regulations issued by the Trump administration. After submitting comments in January of this year on the US Department of Education’s proposed revisions to the regulations, the AAUP joined the attorneys general of eighteen states in calling in March for the department to suspend the rulemaking process for the proposed regulations during the COVID-19 crisis. However, the process continued, and the department announced the revised regulations in May, whereupon the AAUP reiterated its stance on the regulations in a formal response. Throughout the rulemaking process, the AAUP’s recommendations regarding Title IX regulations built upon the analysis and recommendations made in the AAUP’s 2016 report The History, Uses, and Abuses of Title IX.
